Since 2003, our team has been conducting closings and issuing title insurance as Collier Insurance Agency, LLC until January 1, 2023 when we changed our name to BCC Title Agency. As Collier Insurance Agency, LLC grows, our team thought it was important to distinguish ourselves from the types of insurance we, as individuals, are more accustomed to purchasing such as health insurance, homeowner’s insurance and automobile insurance. There are two very distinct ways that makes Title Insurance unique:
First, it protects you from any claims prior to you taking ownership, such as:
- Title forgeries
- Back taxes from a former owner
- Filing errors in the land records
- Unknown heirs to an estate in the chain of title who claim ownership
- Inconsistent or conflicting wills
- Liens, commonly from unpaid home equity lines of credit (HELOCs)
- Liens from unpaid contractors and/or subcontractors
- Undocumented easements
Second, it is a one-time premium at time of closing – not monthly payments into the future. The rates are set by the State of Florida and even though we are allowed to charge more, our office does not.
The two most common types of policies in residential and commercial closings are an Owner’s Policy of Title Insurance and a Loan Policy of Title Insurance.
- Owner’s Policy of Title Insurance: If a claim is made against your property, title insurance will, in accordance with the terms of your policy, assure you of a legal defense – plus pay all court costs and related fees. Once you purchase an Owner’s Policy of Title Insurance, you do not need to purchase another policy unless you make substantial improvements to your home and you want to increase your amount of insurance.
- Loan Policy of Title Insurance: This protects your lender’s interest in the property and you would not be able to make any claims through their policy. Once the loan is paid off, their coverage ends. Having an Owner’s Policy of Title Insurance also entitles you to discounted loan policy premiums should you decide to refinance your home.
As a full-service title company, issuing title insurance is only part of what we do. A title company does not represent any one party in the transaction. We are not attorneys and as such, we cannot provide any legal advice. Our responsibility is to act as the middle person between the buyer(s), seller(s), lender and real estate agent(s). We work very hard to make sure all parties involved are moving forward and on the same page. Our experienced team is here to answer any questions, even after closing. After all, we do this every day but it is not every day you purchase or sell your property!
